1. Acceptance of Terms

By accessing or using the Dots and Skills application or related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you and Base Apps, Inc. (“we”, “our”, or “us”).


2. Who May Use the Service

The Dots and Skills app is intended for parents or legal guardians of children. By using the Service, you confirm that:

  • You are at least 18 years of age

  • You are using the app on behalf of yourself and/or your child

  • You have the legal authority to consent to the collection and use of your child’s data as described in our Privacy Policy

Children under 13 may not create accounts or use the app independently.


3. User Accounts and Responsibilities

When registering or using the app, you agree to:

  • Provide accurate, current, and complete information

  • Maintain the confidentiality of your login credentials

  • Be solely responsible for all activity under your account

  • Supervise your child’s use of the app and content submitted on their behalf

We reserve the right to suspend or terminate any account that violates these Terms.


4. Subscriptions and Payments

Dots and Skills may offer auto-renewable subscriptions via the Apple App Store. By purchasing a subscription, you agree that:

• Payments are processed through Apple's platform

• Your subscription will automatically renew unless cancelled at least 24 hours before the renewal date

• You can manage or cancel your subscription via your device's Settings > Apple ID > Subscriptions

• Refunds are handled according to Apple's refund policy; we do not issue refunds directly

• We may change subscription pricing with prior notice via the App or App Store

5. Use of the Service and Content

The Service and its content (including tasks, illustrations, audio, and feedback mechanisms) are the property of Base Apps, Inc. You may not:

  • Reproduce, distribute, or publicly display content without written permission

  • Use the Service for commercial or unlawful purposes

  • Upload harmful or inappropriate content

  • Interfere with the Service’s functionality or security

We grant you a limited, non-exclusive, non-transferable license to use the app in accordance with these Terms.


6. User-Generated Content

You and your child may upload content (e.g., voice recordings, drawings, answers). You retain ownership of this content but grant us a license to:

  • Use, store, and analyze the content to provide app functionality

  • Improve our services (anonymously and in aggregate)

  • Share data with third-party services as outlined in our Privacy Policy

You are responsible for ensuring that uploaded content does not violate copyright, privacy, or any law.


7. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your account if:

  • You violate these Terms

  • We are required to do so by law

  • Continued access is no longer viable (e.g., discontinued service)

Upon termination, we may delete or anonymize your data, except where required to retain it by law or for legitimate business purposes.


8. Disclaimers

The Service is provided “as is” and “as available”. We do not guarantee that:

  • The app will always function without interruption or errors

  • Content is free from inaccuracies or typographical errors

  • Your use will achieve specific learning or developmental outcomes


To the maximum extent permitted by law, we disclaim all warranties, express or implied.


9. Limitation of Liability

To the fullest extent permitted by law, Base Apps, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use or inability to use the Service

  • Any bugs, errors, or performance issues

  • Unauthorized access to your account or data

Our total liability in any circumstance is limited to the amount you paid for the Service in the last 12 months.


10. Third-Party Services and Links

The Service may integrate or link to third-party services. We are not responsible for the privacy practices, content, or reliability of these services. Use of third-party services is subject to their respective terms.


11. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified via the app or email. Continued use of the Service after changes take effect constitutes your acceptance.


12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law principles. All legal disputes shall be resolved in the competent courts of California.
